ILLEGAL HEMP-DERIVED CANNABINOIDS
Banned Intoxicating Cannabinoids:

Synthetic Derivatives:
Virginia Code § 59.1-200(A)(69) prohibits any synthetic derivative of THC, defined as:
"A chemical compound produced by man through a chemical transformation to turn a compound into a different compound by adding or subtracting molecules to or from the original compound."
Note: Natural isomers of Delta-9 THC are not considered "synthetic" under this definition, but they still must meet the total THC limits.
ILLEGAL PRODUCT TYPES & FORMATS
1. Products Exceeding THC Limits (Va. Code § 3.2-4126)
BANNED:
- Any product with more than 0.3% total THC (by dry weight)
- Any product with more than 2mg total THC per package UNLESS it maintains a 25:1 CBD-to-THC ratio
"Total THC" includes:
- All THC isomers (Delta-8, Delta-9, Delta-10, etc.)
- THCA (calculated as THCA × 0.877)
- Formula: All THC isomers + (THCA × 0.877) = Total THC
2. Packaging & Shape Restrictions (Va. Code § 3.2-4123(B))
ABSOLUTELY BANNED - Products that:
- Depict or are shaped like a human
- Depict or are shaped like an animal
- Depict or are shaped like a vehicle
- Depict or are shaped like fruit
- Resemble candy, snacks, or other products marketed to minors
- Bear significant likeness to another manufacturer's product (copycat products)
- Have packaging that appeals to persons under 21
3. Products Without Required Packaging (Va. Code § 3.2-4123(A)(1))
ILLEGAL if containing THC and lacking:
- Child-resistant packaging
- Resealable packaging (if product contains more than one serving)
4. Products With Inadequate Labeling
BANNED if missing any of these required label elements:
- All ingredients listed
- Amount constituting a single serving (in weight or volume)
- Total percentage of THC in the product
- Total milligrams of THC in the package
- Milligrams of THC per serving
- Statement: "May not be sold to persons younger than 21 years of age"
- Batch code matching Certificate of Analysis (COA)
- Certificate of Analysis from ISO 17025 accredited lab
5. Products Sold Without Retail Registration
ILLEGAL to sell:
- Any regulated hemp product without a Regulated Hemp Product Retail Facility Registration (required since November 15, 2024)
- Annual fee: $1,000 per location
- Penalty for non-compliance: $2,000 initial civil penalty
SPECIFIC BANNED PRODUCT CATEGORIES

Topicals:
- Topical hemp products without a label stating "not intended for human consumption"
KEY ENFORCEMENT POINTS
Virginia's Law Supersedes Federal Hemp Definition:
The Fourth Circuit Court of Appeals ruled in January 2025 that Virginia's restrictions are NOT preempted by the 2018 Farm Bill. Virginia can:
- Use "total THC" instead of just "delta-9 THC"
- Impose stricter limits than federal law
- Ban products that are federally legal hemp
Active Enforcement:
- 80% of inspected stores (900+ inspections) received civil penalties by early 2025

Virginia has effectively closed the "intoxicating hemp loophole" by:
- Banning all synthetic cannabinoids
- Using "total THC" (not just delta-9)
- Imposing strict 2mg per package limits
- Requiring 25:1 CBD:THC ratio for higher-THC products
- Banning child-appealing packaging and shapes
These restrictions apply TODAY, regardless of federal hemp rules. The Fourth Circuit has confirmed Virginia has this authority under its police powers to protect public health and safety.
